Agreement
These Terms of Use (“Terms”) apply to the Takeback iPhone app and the website takeb.io. By using Takeback you agree to these Terms. If you don’t agree, don’t use it. Use of the app downloaded from the App Store is also subject to Apple’s Licensed Application End User License Agreement.
What Takeback does
Takeback is a self-custody tool. It helps you create and broadcast a replacement for an unconfirmed Bitcoin transaction that you sent, either to pay a higher fee (“speed up”) or to send the same coins back to an address you control (“cancel”). All signing happens on your device with a key you provide.
You are in control
We never hold, receive or have access to your keys or bitcoin. We cannot move, freeze, recover or refund funds, and we cannot reverse transactions. You are solely responsible for your keys, your devices, and every transaction you approve.
No guarantee of results
Whether a replacement confirms depends on the Bitcoin network, node policies and miners, which we don’t control. A replacement may fail, for example if the original transaction is confirmed first, if fees change, if some inputs belong to another wallet, or if servers reject it. Network fees you pay for a replacement are not refundable. Canceling a payment may also cancel later transactions that depend on it, as shown in the app.
Acceptable use
Only use Takeback with keys and funds that you own or are authorized to control. Don’t use it to defraud anyone, including by canceling a payment after receiving goods or services in exchange for it. Don’t use it in violation of any law or sanctions that apply to you.
Open-source license
The Takeback source code is published at github.com/devdasx/takeback under the license included in that repository. That license governs your use of the source code. These Terms govern your use of the app and website we distribute.
Third-party services
Takeback relies on third-party Bitcoin servers such as Electrum servers and mempool.space, and links to third-party websites. We aren’t responsible for their availability, accuracy or practices.
Disclaimer of warranties
Takeback is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that it will be error-free, secure or uninterrupted, or that any transaction will succeed.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of bitcoin, funds, data or profits, arising from your use of or inability to use Takeback. Where liability can’t be excluded, our total liability is limited to the amount you paid us for the app in the 12 months before the claim, if any. Some jurisdictions don’t allow these limits, so they may not apply to you.
Changes and termination
We may update Takeback or these Terms. We’ll update the date at the top when we do, and continued use means you accept the updated Terms. You can stop using Takeback at any time by deleting the app.
Governing law
These Terms are governed by the laws of the place where the Takeback publisher is established, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise.
